5. Payment Terms

6. Delivery and Service Area
Delivery services are available only within designated delivery zones as determined by Pizzana at our sole discretion. Delivery zones, minimum order amounts, and delivery fees are subject to change at any time. We cannot guarantee specific delivery times due to factors beyond our control, such as traffic conditions, weather, and order volume. Estimated delivery times provided at checkout are approximate only and are not guaranteed.
We shall not be liable for any loss, damage, or inconvenience arising from delayed or failed delivery due to circumstances beyond our reasonable control, including but not limited to acts of God, severe weather conditions, road closures, or other force majeure events.
7. Allergen and Dietary Information
Pizzana makes reasonable efforts to provide accurate allergen and nutritional information for our menu items. However, our food is prepared in a kitchen environment where allergens such as nuts, dairy, gluten, eggs, shellfish, and other common allergens are present. We cannot guarantee that any menu item is completely free from allergens or cross-contamination.
If you have a food allergy or dietary restriction, we strongly encourage you to contact us directly before placing your order to discuss your specific needs. Pizzana shall not be held liable for any allergic reactions or adverse health effects resulting from the consumption of our food products.
8. Intellectual Property Rights

IN ANY CASE, PIZZANA'S TOTAL CUMULATIVE LIABILITY TO YOU ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED DOLLARS ($100.00 USD), OR (B) THE TOTAL AMOUNT PAID BY YOU TO PIZZANA IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some states do not allow limitations on implied warranties or exclusions of certain types of damages, so some of the above limitations may not apply to you in their entirety. In such cases, our liability will be limited to the maximum extent permitted by applicable state law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Pizzana and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your access to or use of the Site and our Services;
- Your violation of these Terms of Service;
- Your violation of any applicable federal, state, or local law or regulation;
- Your infringement of any third-party right, including but not limited to intellectual property rights, privacy rights, or publicity rights;
- Any User Content you submit, post, or transmit through the Site;
- Your negligent or willful misconduct;
- Any dispute between you and any other user of our Services.
We reserve the right, at our expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses. You shall not settle any claim without our prior written consent.
13. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America and applicable state law, without regard to conflict of law principles that would cause the application of the laws of any other jurisdiction.

These Terms and your use of our Services are also subject to applicable federal laws and regulations, including but not limited to the Federal Trade Commission Act (15 U.S.C. § 41 et seq.), which prohibits unfair or deceptive acts or practices in commerce, and the Electronic Signatures in Global and National Commerce Act (E-SIGN Act).
If you are a California resident, you may also have rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and the California Unfair Competition Law (Cal. Bus. & Prof. Code § 17200 et seq.), which are addressed further in our Privacy Policy.
14. Dispute Resolution and Arbitration
14.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact Pizzana at [email protected] and provide a written description of the dispute, the relief sought, and your contact information. You and Pizzana agree to attempt to resolve any dispute through good-faith informal negotiation for a period of thirty (30) days from the date of the written notice.
14.2 Binding Arbitration
If the parties are unable to resolve the dispute through informal negotiation within thirty (30) days, any dispute, claim, or controversy arising out of or relating to these Terms, or to the breach, termination, enforcement, interpretation, or validity thereof, or to the use of our Services (collectively, "Disputes"), shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, except as modified herein.
The arbitration shall be conducted in English, and the arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitrator shall have authority to award any relief that a court of competent jurisdiction could award. The arbitration shall take place in the United States at a location mutually agreed upon by the parties, or, if no agreement can be reached, at a location determined by the AAA.
14.3 Class Action Waiver
14.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. Additionally, claims that by law cannot be subject to mandatory arbitration are excluded from the scope of this arbitration provision.
14.5 Time Limitation on Claims
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OR SUCH CLAIM WILL BE PERMANENTLY BARRED.
15. Term and Termination
These Terms shall remain in full force and effect for as long as you continue to access or use our Site or Services. We reserve the right, in our sole discretion, to:
- Terminate or suspend your access to all or any part of our Services at any time, with or without cause, with or without notice;

Pizzana shall not be liable for any failure or delay in performing our obligations under these Terms to the extent such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions or restrictions, wars, civil unrest, labor disputes, power outages, internet or telecommunications failures, or other force majeure events. In such circumstances, we will make reasonable efforts to notify you and resume performance as soon as practicable.
18.6 Electronic Communications
By using our Services and providing your email address, you consent to receive electronic communications from us, including order confirmations, receipts, customer service communications, and marketing communications (where you have opted in). You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. - The Food Safety Modernization Act (FSMA) and applicable FDA regulations;
- State and local health department regulations and food safety standards;
- The Americans with Disabilities Act (ADA) with respect to accessibility of our website and physical premises;
- The Federal Trade Commission Act (FTC Act) with respect to truth in advertising and unfair or deceptive trade practices;
- Applicable state consumer protection laws;
- Payment Card Industry Data Security Standards (PCI DSS) with respect to the handling of payment card information.
